The Internal Revenue Service (IRS) has released a new version of Form I-9, Employment Eligibility Verification, which will be required for all new hires starting in 2024. The new form includes some important changes that employers need to be aware of. Review the new I-9 rules for 2024 below.
New E-Verify Checkbox
The new Form I-9 includes a new checkbox for employers enrolled in E-Verify to indicate that they remotely examined identity and employment authorization documents under an alternative procedure authorized by the Department of Homeland Security (DHS). This alternative procedure allows employers to remotely examine documents using video conferencing or other secure methods.
Automatically Extended Employment Authorization Documents (EADs)
On March 1, 2023, USCIS announced that it was automatically extending the validity of certain EADs for an additional 18 months. This was done to help reduce the burden on USCIS and employers during the COVID-19 pandemic.
The new Form I-9 includes instructions on how to reverify employees with automatically extended EADs. Employers must reverify these employees before they start work on November 4, 2024.
Other Changes
The new Form I-9 also includes some minor changes to the instructions and layout. However, the overall requirements for completing the form remain the same.
What Employers Need to Do
Employers should start using the new Form I-9 as soon as possible. They should also update their Form I-9 policies and procedures to reflect the new changes.
Employers who are enrolled in E-Verify should review the new E-Verify checkbox and determine whether they want to use the alternative procedure for remotely examining documents.
Employers should also review their records to identify any employees with automatically extended EADs. These employees will need to be reverified before they start work on November 4, 2024.
